Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the EDM.Social mobile application, websites, and related services (the “Service”), provided by EDM.Social (“EDM.Social,” “we,” “us,” or “our”). The Service helps you discover electronic dance music events, follow artists, and save the shows that matter to you.

Please read these Terms carefully. By creating an account, downloading, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements and that you are able to form a binding contract with us. Events listed in the Service may have their own age restrictions set by venues and promoters, and you are responsible for meeting them.

Your account

An account is required to use the Service. You can register with an email address and password or by using Sign in with Apple or Google. You agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@edm.social if you suspect unauthorized use of your account. You may delete your account at any time as described in our Account & Data Deletion page.

License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the Service on devices you own or control, for your personal, non-commercial use. We reserve all rights not expressly granted to you.

Acceptable use

You agree not to:

  • Use the Service in any way that violates applicable laws or regulations, or the rights of others.
  • Copy, scrape, crawl, harvest, or otherwise extract data from the Service except as expressly permitted, or build a competing product using our content.
  • Reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by law.
  • Interfere with, disrupt, or place an unreasonable load on the Service, or attempt to gain unauthorized access to it or its related systems.
  • Upload or share content that is unlawful, infringing, defamatory, harassing, hateful, fraudulent, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
  • Use the Service to send spam or unsolicited communications, or to collect information about other users without their consent.

User content

The Service lets you create a profile and submit information such as a username, display name, photo, bio, and your activity, such as the events you save, RSVP to, or the artists you follow (“User Content”). You retain ownership of your User Content. You grant EDM.Social a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use your User Content as needed to operate, provide, and improve the Service. You are solely responsible for your User Content and represent that you have the rights necessary to share it and that it does not violate these Terms or the rights of others.

We may, but are not obligated to, review, monitor, or remove User Content, and we may remove or restrict content or accounts that we believe violate these Terms or are otherwise harmful.

Event information and third-party content

Event listings, lineups, dates, times, venues, prices, and related details are aggregated from third-party sources, including promoters, venues, ticketing platforms, and public data providers. We do not create this information and cannot guarantee that it is accurate, complete, or current. Events may be changed, rescheduled, sold out, or canceled without notice. The information in the Service is provided for general informational purposes only, and you should confirm event details directly with the venue, promoter, or official ticketing provider before making plans or purchases.

The Service may contain links to third-party websites and services, such as ticketing platforms. Any purchases or transactions you make through those third parties are solely between you and that third party and are governed by their terms and policies. We are not responsible for third-party websites, services, ticket sales, refunds, or the conduct of venues, promoters, or artists.

Subscriptions and purchases

The Service offers a free, ad-supported tier and may offer paid subscriptions and other in-app purchases that unlock premium features (“Premium”). Purchases are processed by the Apple App Store or Google Play, and are subject to their terms in addition to these Terms.

  • Billing and auto-renewal. Paid subscriptions are billed through your Apple or Google account at the price and interval shown at purchase. Subscriptions automatically renew for successive periods unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • Managing and canceling. You can manage or cancel your subscription in your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to Premium until then.
  • Free trials and promotions. If we offer a free trial or promotional price, unused portions are forfeited when you purchase a subscription, where applicable, and the subscription converts to a paid, auto-renewing subscription unless canceled beforehand.
  • Refunds. Except where required by law, payments are non-refundable, and refunds, when available, are handled by Apple or Google under their policies.
  • Price changes. We may change subscription prices and features. Changes apply to future billing periods, and where required we will give you advance notice and the opportunity to cancel.

Advertising

The free tier of the Service is supported by advertising. By using the free tier, you acknowledge that we and our advertising partners may display ads within the Service. Advertising practices and your related choices are described in our Privacy Policy.

Intellectual property

The Service, including its software, design, text, graphics, logos, and other content we provide (excluding User Content and third-party content), is owned by EDM.Social or its licensors and is protected by intellectual property laws. The EDM.Social name and logo are our trademarks. You may not use them without our prior written permission. Artist, venue, promoter, and event names and marks are the property of their respective owners.

Feedback

If you send us suggestions or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use it for any purpose without any obligation or compensation to you.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Upon termination, the license granted to you ends, and the provisions of these Terms that by their nature should survive, including ownership, disclaimers, limitations of liability, and dispute resolution, will continue to apply.

Disclaimers

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that event or other information will be accurate, complete, or current. Your use of the Service is at your own risk, and you are responsible for your own safety when attending events.

Limitation of liability

To the fullest extent permitted by law, EDM.Social and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or 50 US dollars. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless EDM.Social and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms or applicable law.

Governing law and disputes

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-laws principles. Subject to applicable law, any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, you and EDM.Social agree to resolve disputes on an individual basis and waive any right to participate in a class or representative action. Nothing in these Terms limits any non-waivable statutory rights you may have under the laws of your country of residence.

Apple App Store additional terms

If you obtain the app through the Apple App Store, the following additional terms apply, and they prevail over any conflicting terms above with respect to your use on Apple devices:

  • These Terms are between you and EDM.Social only, and not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide any maintenance or support for the app.
  • In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app or your use of it infringes that party's intellectual property rights.
  • You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

Google Play additional terms

If you obtain the app through Google Play, your use is also subject to the Google Play Terms of Service. To the extent of any conflict regarding your download or use of the app from Google Play, the Google Play terms apply to that subject matter.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice within the Service. Your continued use of the Service after an update takes effect means you accept the revised Terms.

Miscellaneous

These Terms, together with the Privacy Policy and any additional terms you agree to, are the entire agreement between you and EDM.Social regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of it. You may not assign or transfer these Terms without our consent, and we may assign them in connection with a merger, acquisition, or sale of assets.
